Bay City Attorney David Powers Named to Great Lakes Water Levels Study

Panel Aims to Obtain Information to Determine Future Action on Water Levels

A local leader of the Save Our Shoreline (SOS) organization, David L. Powers, is one of a ten-member board overseeing a five year, $15 million study of Great Lakes water levels.

Mr. Powers is a practicing attorney in Bay City with the firm of Smith, Martin, Powers & Knier, P.C. He co-founded and served as Vice President of SOS, a 3,200-member organization of Great Lakes property owners.

In his role with Save Our Shoreline, Dave helped negotiate passage of Michigan's Beach Grooming Law, 2003 PA 14, and helped raise awareness of the proliferation of phragmites, a non-native, invasive plant, along the shores of Saginaw Bay and western Lake Huron.

He was also lead counsel for the property owners position in the widely publicized case of Glass v Goeckel, 473 Mich 667 (2005), involving the extent of riparian and public rights along Michigan?s Great Lakes shoreline.

The International Joint Commission (IJC) recently named Mr. Powers to its Study Board for the Upper Great Lakes Levels Study and U.S. Co-Chair of the Study's Public Interest Advisory Group. The IJC is a bi-national agency formed in 1909 by the governments of the U.S. and Canada to make recommendations regarding waters along the shared border.

"There are a lot of differing views about how water levels should be regulated," said Mr. Powers. "People from the Georgian Bay area are concerned with low water, while Michigan's residents worry about high water, especially in Lake Michigan. Environmentalists are concerned about preserving wetlands, and we are concerned about beaches. Clearly, there are a lot of interests that must be considered in regulating water levels."

"Dave's appointment to this important position shows how SOS continues to gain respect and influence regarding Great Lakes matters," said SOS President Ernie Krygier. "With Dave there, we know that our problems with low water, like rampant phragmites growth, will not be ignored."

The IJC study is in two phases, 1-whether the St. Clair River is continuing to erode and is draining the lakes, and 2-focusing on Lake Superior and its impact on lakes Huron and Michigan. The study is slated to be completed in 2012. For more information please access www.ijc.org.

Dave is listed in "Who's Who in American Law" and "Who's Who in the World." In 2006, he was named "Super Lawyer" by Law & Politics Magazine, and in 2009, he was identified as a "Leader in the Law" by Michigan Lawyers Weekly newspaper. He resides with his wife and two boys on the shore of Saginaw Bay.

His legal work includes three published articles and ten published cases in state and federal courts. He also served as president of the Bay County Bar Association; former chairman of the Bay City Downtown Management Board; and board member of the Bay Area Chamber of Commerce.

He earned a bachelors degree from Alma College and a juris doctor degree from the University of Detroit School of Law.
